In case you require a secondary viewpoint, you have the liberty to request another expert through our platform or independently find one.

Third-party Experts: Claimfinder acts as an introduction platform connecting users with third-party claim experts. We will not be liable for the actions, advice, services, or agreements provided by these experts. Any interactions, dealings, or disputes between users and claim experts are solely between those parties.

Communication Breakdown: While we employ best practices to ensure the security and reliability of our communication channels, Claimfinder is not responsible for any breakdowns, interruptions, malware, or unauthorized access to communications and data, unless directly attributable to our intentional misconduct.

MFA and Data Security: Although Claimfinder uses Multi-Factor Authentication (MFA) and advanced security protocols, no method is 100% secure. Users are responsible for managing their MFA details and maintaining the security of their accounts. Claimfinder is not liable for losses related to compromised MFA details.

Maximum Liability: Notwithstanding any contrary provision in this agreement, Claimfinder's aggregate liability for all claims relating to the services provided, irrespective of the cause or form of action, whether in contract or tort, shall at all times be limited to the amount paid, if any, by the user for the services during the 12 months prior to the action giving rise to liability.

No Guarantees: Claimfinder offers no warranties or guarantees, express or implied, regarding the accuracy, reliability, and completeness of information provided on its platform or by third-party experts. Users rely on this information at their own risk.

Indemnity Not Affected: Nothing in this limitation of liability clause affects any indemnification rights or obligations that may exist elsewhere in our terms and conditions.Users acknowledge and agree that the limitations of liability set forth above are fundamental elements of the basis of the bargain between Claimfinder and the user and that the services would not be provided to the user absent such limitations.

Jurisdiction

Any disagreements or claims related to our services will be determined and construed following the laws of New South Wales. By accessing our services, you agree to submit to the legal jurisdiction of the courts of New South Wales concerning these Terms of Use.

Terms Modifications

Modification Rights: Claimfinder reserves the right to modify, amend, or revise the terms of this agreement at its sole discretion.

Notification: Should any changes be made, Claimfinder will provide notice to the parties involved, either by posting the revised terms on our website, through email notification, or other appropriate means.

Free Claim Check Waiver: Claimfinder offers a free claim check based on the information provided by the client. Clients acknowledge and agree that the results or evaluations of this check are purely indicative and rely entirely on the accuracy and completeness of the information they provide. Claimfinder shall not be held responsible for any decisions made or actions taken based on the results of the free claim check.

Referral Rewards Program: Claimfinder may offer a referral program, allowing clients to refer friends, family, or colleagues to use our services. Specific terms, conditions, rewards, or benefits related to the referral program will be outlined separately and may be subject to change. Clients participating in the referral program agree to abide by the specific terms set out for the program.

Acceptance: The amended terms will be considered accepted by the parties if no objections or concerns are raised within 7 days of receiving the notice. If any party does not agree to the revised terms, they must notify Claimfinder of their objections or concerns in writing within the 7-day period.

Continued Use: The continued use of services after the 7-day period, without raising objections or concerns, will constitute acceptance of the new terms.

Date of Effect: Unless otherwise stated in the notice, all changes will become effective immediately after the end of the 7-day period or as indicated in the notice.

No Waiver: Failure to exercise this right by Claimfinder on any occasion or occasions will not constitute a waiver of the right and will not prevent Claimfinder from exercising the right at a later date.
